About these terms
These Terms of Use (the “Terms”) apply whenever you use Sugary, including our websites, mobile apps and related services. By creating an account, placing an order or otherwise using Sugary, you agree to them. If you don’t agree, please don’t use Sugary.
These Terms are an agreement between you and:
- Licence no.
- 06937
- Registered address
- Block C, Building 9W, Al Twar 1, PO Box 293962, Dubai, UAE
In these Terms, “Sugary”, “we”, “us” and “our” mean that company, and “you” means the person using Sugary.
Our Privacy Policy, Shipping Policy, Return & Refund Policy and Cookie Policy form part of these Terms. Some features, promotions and gift cards have extra terms, which we show you before you use them. Where those extra terms conflict with these Terms, the extra terms apply to that feature.
If you use Sugary for a business, you confirm you’re authorised to accept these Terms for it, and “you” includes that business.
How Sugary works
Sugary is a gifting marketplace. Most products are made and supplied by independent businesses (“Stores”). Items in the Sugary Store are sold by us.
- Stores
- Independent businesses that sell through Sugary. Each Store is responsible for its products, including their quality, safety and description.
- Sender
- The person who buys and sends a gift.
- Recipient
- The person the gift is for. Recipients don’t need an account to receive a gift.
We provide the platform and customer support. Each Store is responsible for what it supplies, but that doesn’t limit our Return & Refund Policy or your legal rights.
Some features, such as Gift Link™ and Gift Swap™, let a recipient add their own delivery details or exchange a gift. Any conditions are shown when you use them.
Your account
- You must be at least 18 and able to enter into a binding contract to create an account or place an order.
- Give us accurate details and keep them up to date.
- One account per person. Don’t create an account for someone else, or share yours.
- Keep your password safe. You’re responsible for activity on your account, so tell us straight away if you think someone else has used it.
- If you sign in through another service, its terms also apply to that sign-in.
You can close your account at any time. Orders you’ve already placed will still be delivered unless you cancel them under our Return & Refund Policy.
Orders, prices and payment
Placing an order is an offer to buy. A contract is formed when we confirm your order. Until then, we or the Store may decline it, for example if an item is unavailable, delivery isn’t possible or we suspect fraud. If we decline an order after you’ve paid, you get a full refund.
- Prices
- Prices can change, but you pay the price shown when you place your order. If there’s an obvious pricing error, we’ll contact you before going ahead, and you can cancel for a full refund.
- Currencies
- Prices shown in other currencies are a guide. Your bank or card issuer may apply its own exchange rate and fees.
- Your total
- Checkout shows item prices, delivery charges, taxes and discounts before you pay.
- Payment
- We accept the payment methods shown at checkout. Payments are processed by third-party payment providers, whose terms may also apply. Cash on delivery isn’t available.
- Bespoke orders
- For custom or bespoke work, we may ask for a deposit before it starts. We’ll tell you the amount and when the balance is due.
- Promo codes
- Promo codes have no cash value and may have conditions, such as an expiry date or minimum spend. We may cancel a code that’s used fraudulently or against its conditions.
If something you ordered isn’t available, we’ll contact you. We never substitute an item without asking, and if a replacement costs more, it’s your choice whether to pay the difference.
Delivery, cancellations and refunds
Delivery options, dates and charges depend on the item and the address, and are shown at checkout. Our Shipping Policy explains delivery in more detail.
What you can cancel, return or get refunded depends on the item. Our Return & Refund Policy covers each case.
Please check delivery details carefully. If a gift can’t be delivered because the details were wrong or incomplete, or the recipient refuses a gift that was correct, we may not be able to refund it.
Gift cards and digital gifts
- Digital gift cards are issued by the brand named on the card and can be used only under the conditions and expiry date shown on it.
- Some gift cards can be used only in certain countries. We tell you before you buy.
- Treat a gift card code like cash. We can’t replace a code that has been shared, lost or used by someone else.
- Gift cards can’t be exchanged for cash and aren’t refundable once bought, unless the law says otherwise. Our Return & Refund Policy explains any exchange options.
- Digital gifts are sent to the contact details you give us, so please check them carefully.
Personalised and bespoke gifts
When you ask for a name, message, photo or design to be added to a gift, you’re responsible for that content. Make sure you have the right to use it, and that it isn’t offensive, unlawful or someone else’s intellectual property. We or the Store may refuse personalisation that breaks these rules.
Handmade, fresh and personalised items can differ slightly from their photos. If an important part of a gift isn’t available, we’ll contact you before making a change.
Personalised items are made just for you, so they usually can’t be cancelled once work has started. If one arrives wrong, damaged or faulty, our Return & Refund Policy applies.
Your content
Your content is anything you add to Sugary, such as reviews, photos, gift messages, profile details and messages. You keep ownership of it.
You give us a worldwide, non-exclusive, royalty-free licence to host, use, copy, adapt, display and share your content to run, improve and promote Sugary. The licence ends when you delete the content or your account, except for content already shared with others or that we must keep by law.
Content you choose to make public can be seen by others. Gift messages are seen by those involved in preparing and delivering the gift, and by the recipient.
Don’t post anything false, misleading, hateful, harassing, sexually explicit, unlawful or that infringes someone else’s rights. Reviews must reflect a genuine experience. We may remove content that breaks these Terms, and we’re not responsible for content posted by others.
If you send us feedback or ideas, we may use them freely, without any obligation to you.
Using Sugary fairly
When you use Sugary, please don’t:
- use it for anything illegal, fraudulent or harmful
- pretend to be someone else, or give false information about who you are
- harass, threaten or spam other users, recipients, Stores or our team
- send gifts to someone who has made it clear they don’t want to hear from you
- post fake reviews, or manipulate ratings, promotions or rewards
- collect data from Sugary in bulk with bots, scrapers or other automated tools without our written permission
- probe, disrupt or overload our systems, spread malware, or get around our security
- copy, reverse engineer or resell Sugary or any part of it, or buy products for resale without our agreement
If you find a security issue, please report it to us privately through Help & Support.
Our content and trademarks
Sugary, our logos, product names, and the design, text, images and software of Sugary belong to us or our licensors and are protected by law. Product photos and descriptions belong to the Stores that provide them.
We give you a personal, non-transferable licence, which we can withdraw, to use Sugary for finding, sending and receiving gifts. You can’t use our brand or content for anything else without our written permission.
Third-party services
Sugary uses third-party services to operate. Their own terms and privacy policies apply to their services, and we’re not responsible for them. Links to other websites are there for convenience; we don’t control those sites.
If you downloaded our app from an app store, these Terms are between you and us, not the app store operator, which has no obligation to support the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them as they relate to the app. You confirm that you’re not located in a country under a US government embargo, and you’re not on any US government list of restricted parties.
Suspending or closing accounts
We may suspend or close your account, cancel pending orders or limit features if we reasonably believe you’ve broken these Terms or the law, created a risk of fraud or harm, or if we’re legally required to. Where it’s appropriate and lawful, we’ll tell you why and give you a chance to respond. If we cancel a paid order and you’ve done nothing wrong, we’ll refund you.
We may change, pause or stop parts of Sugary. If we stop offering Sugary altogether, we’ll give you reasonable notice and deliver or refund any orders you’ve already paid for.
Parts of these Terms that are meant to continue after your account closes, such as the content licence, liability and disputes sections, keep applying.
Our responsibility to you
We work hard to keep Sugary running smoothly, but we provide it “as is” and “as available”. To the extent the law allows, we don’t promise that Sugary will always be available, error-free or secure, or that Store descriptions will always be complete.
To the extent the law allows, we’re not liable for:
- indirect or consequential losses, or losses that weren’t reasonably foreseeable when you placed your order
- loss of profit, business, revenue, data or goodwill
- delays or failures caused by events beyond our reasonable control
- what Stores, delivery partners or other users do, beyond our own responsibilities under these Terms and our Return & Refund Policy
Otherwise, our total liability to you for any claim is limited to the greater of the amount you paid for the order the claim relates to, or US$100.
To the extent the law allows, if your breach of these Terms or the law leads to a claim against us, you agree to cover our reasonable losses and costs from that claim.
Nothing in these Terms limits liability that can’t be limited by law, such as for death or personal injury caused by negligence, or for fraud. Nothing affects your statutory rights as a consumer.
Disputes and governing law
If something goes wrong, please contact us first. We’ll try in good faith to resolve any complaint within 30 days.
These Terms, and any dispute that arises from them or from your use of Sugary, are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. The courts of Dubai have jurisdiction to hear any dispute we can’t resolve informally.
If you’re a consumer, you keep the rights your local law gives you, including the right to bring a claim in the courts where you live.
Changes and other legal details
- Changes
- We may update these Terms. We’ll post the new version here with a new date and tell you in advance about important changes. If you keep using Sugary after they take effect, the new Terms apply. Orders you’ve already placed stay under the Terms in force when you placed them.
- Language
- We may translate these Terms. If a translation differs from the English version, the English version applies, unless the law requires otherwise.
- Transfer
- We may transfer our rights and obligations under these Terms to another company, as long as your rights aren’t reduced. You need our consent to transfer yours.
- Severability
- If a court decides part of these Terms can’t be enforced, the rest still applies.
- No waiver
- If we don’t enforce a right straight away, we can still enforce it later.
- Notices
- We may send notices by email, SMS, in the app, or by posting them on Sugary.
- Entire agreement
- These Terms and the policies they mention are the whole agreement between you and us about using Sugary.
